PROCERA Sp. z o.o., based in Częstochowa, at Wały Dwernickiego 123, 42-202 Częstochowa, registered with the District Court in Częstochowa, 17th Commercial Division of the National Court Register under KRS number 0000959144, REGON 36585544000000, NIP 5732871168, share capital of PLN 5,926,500.00, exercises due diligence to protect the privacy of individuals using its services.
This document, referred to as the Privacy Policy, describes the rules and rights related to the processing of personal data on the platform https://b2b.procera.pl/
and in connection with sales agreements concluded by Procera Sp. z o.o. with entrepreneurs registered on that platform.
1. Definitions
For the purposes of this Privacy Policy, the following terms shall mean:
PROCERA – PROCERA Sp. z o.o., based in Częstochowa, at Wały Dwernickiego 123, 42-202 Częstochowa.
Client – an entrepreneur who concludes a product sales agreement with PROCERA through the B2B Procera platform available at https://b2b.procera.pl/.
User – a person visiting https://b2b.procera.pl/ who is not logged in or does not have a Client Account.
General Terms of Sale – the general terms of sale forming an integral part of the sales agreement concluded between PROCERA and the Client, defining the rights and obligations of the parties related to the sales agreement concluded via the B2B Procera purchasing platform or through orders placed by Clients with an active account, via e-mail, phone, or in person at PROCERA’s headquarters.
GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.
Client Account – the Client’s account on the B2B Procera platform enabling, among others, the purchase of products offered by PROCERA.
2. Data Controller
PROCERA acts as the Data Controller of personal data provided by Clients when using https://b2b.procera.pl/, as well as data obtained in connection with sales agreements concluded with entrepreneurs registered on the platform, and data provided by Users visiting the website who are not logged in or do not have a Client Account. The Controller makes every effort and exercises due diligence to ensure physical, technical, and organizational safeguards against accidental or intentional destruction, loss, alteration, unauthorized disclosure, use, or access to personal data.
3. Purpose, Scope, and Legal Basis for Data Processing
PROCERA processes personal data for the following purposes:
Execution of sales agreements concluded via the B2B platform or by Clients with active accounts (through e-mail, phone, or in person). Data processed: name and surname, company name, representative’s name, registered address, bank account number, e-mail, phone number, and tax identification number (NIP). Legal basis: necessity to perform a contract (Art. 6(1)(b) GDPR).
Creating a Client Account on the platform. Data processed: information provided in the registration form, such as name, company name, address, e-mail, phone number, NIP. Legal basis: necessity to perform a service agreement for the Client Account (Art. 6(1)(b) GDPR).
Services not requiring an account: Data related to site activity (visited offers, sessions, device, OS, browser type, location, ID). Legal basis: legitimate interest of the Controller (Art. 6(1)(f) GDPR).
Providing services to Clients with an active account: Data processed include account details, session data, device, OS, browser, location, ID, and order history. Legal basis: necessity to perform the account and sales agreement (Art. 6(1)(b) GDPR).
Contact and inquiries: Data such as e-mail and phone number may be processed to respond to questions regarding offers or platform operation. Legal basis: legitimate interest (Art. 6(1)(f) GDPR).
Statistical purposes: Data on user activity, visited pages, session times, search history, location, IP, OS, and browser type. Legal basis: legitimate interest (Art. 6(1)(f) GDPR).
Marketing purposes: Client data such as name, company name, address, and e-mail may be processed to inform about promotions and special offers. Legal basis: consent (Art. 6(1)(a) GDPR).
Pursuing claims: Data such as name, company name, address, e-mail, phone number, and NIP may be processed. Legal basis: legitimate interest (Art. 6(1)(f) GDPR).
4. Data Recipients and Retention Period
Personal data may be transferred to:
Service providers enabling the operation of https://b2b.procera.pl/, such as hosting providers and software suppliers;
Authorized public authorities, and entities providing legal, accounting, auditing, or banking services to PROCERA.
Data will be processed until consent is withdrawn, the purpose of processing ceases, or the statutory limitation periods expire.
Data of visitors to https://b2b.procera.pl/ are processed for the lifespan of cookies stored on their devices.
5. Rights Related to Data Processing
Each person whose data is processed has the right to:
a) Withdraw consent at any time (Art. 7 GDPR);
b) Object to processing (Art. 21 GDPR);
c) Request erasure ("right to be forgotten") (Art. 17 GDPR);
d) Access their data and obtain information (Art. 15 GDPR);
e) Rectify inaccurate or incomplete data (Art. 16 GDPR);
f) Restrict processing in certain cases (Art. 18 GDPR);
g) Data portability (Art. 20 GDPR);
h) Lodge a complaint with the supervisory authority (President of the Personal Data Protection Office).
These rights (except h) can be exercised by contacting the Administrator via postal mail or e-mail at biuro@procera.pl.
6. Transfer of Data Outside the EEA
The Controller does not transfer personal data to third countries or international organizations.
7. Automated Data Processing
Personal data is not processed automatically, including through profiling.
8. Changes to the Privacy Policy
Any changes or amendments to this Privacy Policy will be announced on https://b2b.procera.pl/ in a visible place, and in the case of significant changes affecting Clients, also through a message available after logging into the Client Account.
